Terms for using edaga.events.

1. Who we are
edaga.events is a community-first event creation, discovery, invitation and ticketing platform. The platform helps people create public, private or invite-only events; discover profiles, cities and gatherings; follow profiles for alerts; share invitations; and, where available, purchase or manage tickets.
The platform is operated by Edaga Inc., a corporation incorporated under the Canada Business Corporations Act (Corporation No. 1801228-8; Quebec NEQ 1182281734) ("Edaga", "we", "us" or "our").

2. These Terms, and your acceptance
These Terms of Service (the "Terms") govern your access to and use of edaga.events as a visitor, fan, account holder, ticket buyer, ticket holder, promoter applicant or promoter user. By creating an account, following an profile, submitting information, buying or holding a ticket, or otherwise using the platform, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, do not use the platform.
3. Our role
edaga.events is primarily a discovery platform. We publish and organize profile, city, venue and event information and may provide ticketing tools for selected events. Some events are listed for discovery only and are ticketed by a promoter, venue or third-party ticketing provider outside edaga.events.
Unless an event checkout page clearly says that tickets are sold through edaga.events, Edaga is not the seller of tickets for that event. Promoters, venues and third-party ticketing providers remain responsible for their own events, listings, pricing, availability, admission rules, refunds, cancellations and customer service.
4. Eligibility and accounts
- You must be at least 13 years old to browse the platform.
- You must be at least 18 years old, or the age of majority where you live, to buy tickets or apply as a promoter.
- You agree to provide accurate, current and complete information and keep it up to date.
- You are responsible for your account credentials and for activity under your account.
- Tell us promptly at support@edaga.ca if you suspect unauthorized account use.
5. Event listings and availability
We try to keep profile, venue, date, time, price and ticket information accurate, but event details can change. A listing is not a guarantee that an event will happen, that tickets remain available, or that the lineup, venue, time or admission rules will not change. Always review the event page, checkout page and any promoter or venue notices before attending.
6. Tickets, orders and payment
Where edaga.events provides checkout, your order is an offer to buy the selected tickets on the terms shown at checkout. A binding sale is formed when the order is accepted and confirmed. Ticket quantities, prices, fees, taxes and currency are shown before you confirm purchase.
Payments may be processed by Stripe or another third-party payment processor. We do not store full card numbers. You represent that you are authorized to use the payment method you provide.
7. Entry, ticket use and transfers
Tickets may be issued as QR codes or serial numbers. Keep them secure. A ticket is generally valid for one admission unless the event page says otherwise. Door staff may refuse entry if a ticket is invalid, already used, cancelled, refunded, duplicated, or if admission would violate venue, promoter or legal requirements.
We may support ticket transfer features in the future. Until a transfer feature is available, any private resale or transfer is at your own risk and may be refused by the promoter or venue.
8. Cancellations, postponements and refunds
Cancellation, postponement and refund handling depends on who sold the ticket and the policy shown for the event. If edaga.events sold the ticket directly, we will provide the refund or credit process described on the event or order page. If a third party sold the ticket, contact that seller or promoter.
Service fees, processing fees and taxes may be handled differently depending on the payment processor, promoter agreement and applicable law. Nothing in these Terms limits consumer rights that cannot be waived by law.
9. Promoters and submitted events
Promoters may apply for access to submit events or use ticketing/scanning tools. We may approve, reject, suspend or remove promoter access, applications, events or listings at our discretion, especially where a listing is inaccurate, unsafe, unlawful, misleading, political, discriminatory, infringing, fraudulent or harmful to the community or platform.
Promoters are responsible for the events they submit, including rights to use profile, venue, image and listing content; required permits and venue arrangements; taxes; refunds; cancellations; door operations; safety; and compliance with applicable laws.
10. Content you submit
You may submit profile details, profile follows, promoter applications, event information, images, links, messages, reviews or other content. You must have the right to submit it, and it must be accurate, lawful and not misleading, defamatory, infringing, hateful, discriminatory, political campaigning, or otherwise harmful.
You grant Edaga a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, adapt and distribute your submitted content as needed to operate, improve and promote the platform.
11. Acceptable use
You agree not to misuse the platform, including by scraping data, bypassing security, submitting fraudulent orders or tickets, impersonating others, interfering with scanning or entry operations, uploading malicious code, or using the platform for unlawful, political, discriminatory or infringing activity.
12. Intellectual property
The platform, software, design, text, graphics, and the Edaga and edaga.events names and logos are owned by Edaga or its licensors. Profile, promoter, venue and third-party names, images and marks remain the property of their respective owners. You receive a limited, revocable, non-transferable licence to use the platform in accordance with these Terms.
13. Disclaimers
The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Edaga disclaims warranties regarding uninterrupted operation, error-free listings, event availability, third-party services and event outcomes.
Nothing in these Terms excludes, restricts or modifies any right, warranty or remedy that you have under the Quebec Consumer Protection Act or other applicable consumer-protection law that cannot lawfully be excluded.
14. Limitation of liability
To the fullest extent permitted by law, Edaga, its directors, officers, suppliers and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill. Where Edaga is found liable, and to the extent the law permits a limit, Edaga's total aggregate liability for a ticket order will not exceed the greater of the amount you paid for that order or CAD $100. For non-ticket use, Edaga's total aggregate liability will not exceed CAD $100. These limits do not apply to liability that cannot be limited by law.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Edaga, its directors and officers from claims, damages and reasonable expenses arising out of your breach of these Terms, submitted content, promoter activity, misuse of the platform, or violation of any law or third-party right.
16. Suspension and termination
We may suspend or terminate access to the platform, with or without notice, if you breach these Terms, create risk for users or events, or if required to protect the platform, community or legal rights. You may stop using the platform at any time.
17. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date and, where appropriate, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
18. Governing law, language and disputes
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Subject to mandatory consumer rights, the courts of Quebec (district of Montreal) have jurisdiction over disputes.
Consumers: nothing in these Terms requires a Quebec consumer to arbitrate a dispute or waive the right to bring proceedings before Quebec courts, and nothing limits your right to file a complaint with, or seek assistance from, the Office de la protection du consommateur.
Language: these Terms are available in English and French. If you are a Quebec consumer, please review the French version before accepting any English version; the French version is the official version and prevails in the event of any discrepancy. Outside Quebec, the parties have requested that these Terms and related documents be drawn up in English.
